Adding additional living space in the form of an annex is a simple matter with a Fifth Wheel and Travel Trailer. These large static caravans fall within the same laws that govern the use of small touring caravans; those that tow behind a car.  Our Fifth Wheels and Travel Trailers are substantially larger than caravans with living space upto 13' x 32' and are eminently suitable for year-round residential accommodation.

'PLANNING FREE'

In essence, our Fifth Wheels and Travel Trailers are 'planning free' if sited in the direct garden of a house; for use by members of the household as additional living space, rather than independent accommodation.

Though the outline below is neither legal, planning or professional advice, it will help identify our Fifth Wheel's suitability for your planning free needs.

The Fifth Wheel must be sited within the ‘curtilage’ of the dwelling house. This equates to the drive or garden, rather than an adjoining orchard or paddock, for example.

There are three criteria for identifying whether land is within the curtilage of a building, these being:

  • Physical layout

  • Ownership, past and present

  • Use or function, past and present

Is a Fifth Wheel a caravan?  The legal definition of a ‘caravan’ described in the Caravans Sites and Control of Development Acts 1960 and Associated Articles outline three criteria that would asses a Fifth Wheel meeting the definition:

  • Construction test

  • Mobility test

  • Size test

Fifth Wheels are of a timber and metal construction, built upon a wheeled trailer frame, are mobile, and are well within the 20m x 6.8m (external) and 3m internal height.

Use of the annex must be incidental to that of the house; its use must be in conjunction.  There are four accepted judgments for this.

  • The relationship between the respective occupants

  • The relative size of the house, its garden and the caravan

  • The relative scale of accommodation in the caravan and the house

  • The degree to which the caravan is functionally connected to and subordinate to the use of the dwelling house
